What happened?

In late August, a federal judge—U.S. District Judge Jia Cobb—issued an injunction halting the Trump administration’s plan to widen fast-track deportations to include non-citizens residing inside the U.S. who couldn’t prove at least two years of residence. The court found the move violated Fifth Amendment due process rights, particularly for individuals with deeper ties to the country. Despite the administration’s request to delay enforcement while appealing, Judge Cobb refused.Reuters

Why it matters:

  • Preserves due process: People already living in the U.S. can’t be swiftly removed without judicial oversight.
  • Pushes back on expedited deportations: Limits the reach of the administration’s mass deportation plan, at least temporarily.

What’s changing?

BeforeAfter
Fast-track removal for noncitizens with <2 years’ residenceBlocked by court for deeper-rooted residents
Limited judicial review in deportation processGreater safeguards for individuals living in the U.S. long-term

What could come next:

  • The administration may appeal → could go to a higher court.
  • If upheld, it sets a precedent for more protections in deportation cases.
  • Legal groups advocating for immigrants’ rights highlight this as a crucial check on immigration enforcement.
