USCIS has released a new edition of the asylum application, and the clock is already running. Starting August 28, 2026, the old version will not be accepted.
What Happened
USCIS published a new edition of Form I-589, Application for Asylum and for Withholding of Removal, dated 07/28/26. According to the agency’s Forms Updates page, USCIS will accept only the 07/28/26 edition beginning August 28, 2026. Until that date, the prior 01/20/25 edition is still accepted.
The change was posted July 28 and flagged in practitioner alerts in early August, including an August 3 advisory from the H1B Visa Lawyer Blog citing the USCIS Forms Updates page.
Why a Form Edition Date Matters
Using a superseded form edition is one of the most common, and most avoidable, reasons an application comes back. For asylum, the stakes are unusually high, because most applicants must file within one year of their last arrival in the United States. A rejected package that has to be refiled can push a filing past that deadline.
The timing also lands in an already-shifting asylum landscape. Under a separate interim final rule effective July 28, USCIS can now refer certain affirmative asylum applications directly to an immigration judge without the customary asylum-officer interview. USCIS said the change targets a backlog that has grown past 1.4 million cases.

Who Is Affected
Anyone preparing an affirmative asylum application to file with USCIS is affected, as are attorneys and accredited representatives with packages in progress. Applicants with matters before the immigration courts should confirm filing requirements with their representative, since court filing practice can differ.
What You Should Do
Download the form fresh from uscis.gov/i-589 on the day you prepare it, rather than reusing a saved PDF. Edition dates appear at the bottom of each page.
Check the edition date on every page before signing. Mixed-edition packages invite rejection.

If your package is already complete on the 01/20/25 edition, either get it filed comfortably before August 28 or transfer your answers to the new edition now. Do not cut it close to the deadline.
Keep a complete copy of everything you send, plus proof of mailing or an electronic filing receipt.
Do not let a form swap cause you to miss the one-year asylum filing deadline. If that deadline is near, talk to a qualified immigration attorney or an accredited representative before you do anything else.
